it seems that in fact that the "hack" is distributed in every version and merely requires the use of a piece of third party software/hardware, Action Replay Max etc. to enable.
the simple truth is that the content is something which shouldn't be marketed to those underage. particulary after reading a description of the accompanying minigame i have to say that i dont think it unreasonable to raise the rating
not exactly responsible behavior on rockstar's part.
further, saying that this is a violation of freedom of speach is rediculous. that like saying six year olds should be given porn and booze. i under stand the fact that this GTA being given a AO rating makes it harder to buy, welcome to buying booze, porn and cigarettes.
the esrb states: Titles rated AO (Adults Only) have content that should only be played by persons 18 years and older.
note the lack of legal obligation. enjoy it while it lasts.
simply put this is an issue about rockstar being idiots not about freedom of speach. Who, honestly, was like "oh, i know we'll just leave it in and lock it no one will ever find our content?" welcome to reality ladies and gentlemen, if some one can compile linux to run on an ipod, think of what they will do to your video game.
