GPU at 100% in menu and rr

Like the title said, as soon as i get into the main menu or the readyroom my GPU usage shoots up to 100% and gets really hot due to that.
Ingame after i joined a team its back to normal just randomly goes above 90% in the late game but thats probably because its getting a bit old.
I got a GTX460 factory overclocked and newest nvidia drivers , ns2 is the only game with this problem. Maybe its the same stuff starcraft 2 had in beta where the menu tried to render as many frames as possible resulting in a retarded amount of fps? Didnt check with vsync on because vsync is making my game choppy for whatever reason.
At the moment i try to get out of the menu/rr as fast as possible because i dont know if this can cause my gpu to get damaged?

Your GPU may be rendering as fast as possible due to this, which causes it to overheat quickly.
