After further investigating on my end i found out the cause of the problem/crashing. If my EVGA PrecisionX is turned on it causes the crashing. If its turned off the game runs normally. So im not sure whats causing it do do that but if you can investigate and let me know that would be very useful to me.

Is that an overlay? because NS2 does not play well with overlays

no all it really does is make sure my fan is running fast enough to keep my video card cool. Some people use it to overclock there video card but i just make sure its on so i never overheat my video card with the newer games. Here is a link to it if you wanna check it out and see what it does. http://www.evga.com/precision/

    From the key features:
Robust monitoring including ingame OSD with 64 and 32bit support

Seems like me the software is indeed a overlay hooking into the D3DX pipeline causing indeed issues for ns2 and maybe other games. But nice found another software we will have to check for in the future.
