Thanks for the tips. With my hardware, all your extra tweaks makes the game run a little slower (for me anyway). The best performance came from setting nvidia control panel options to Default, and then making just 1 rule for ns2.exe to force vsync off. This ended up doubling my FPS from 20-30 to 35-80, normally in the 40s now.

a myth. your eyes can handle well over 200fps, the only thing limiting you is how fast the neurons in your eye's receptor cells can fire, it's just that at 30+ fps your brain can perceive incoming images as smooth continuous motion and after about 100-120ish the difference in perceived smoothness becomes negligible.
So far my 20-30 is at least letting me play decently at least, a few tips around the forums have let me squeeze a few here and there out of it, though my CPU just isn't up to the task of giving me any more. It's a fairly early duo, not a very good one either, upgrading is never simple when the Motherboard is what is really holding you back, everything must go after that practically, besides my HD 5770 anyways. Though it's tempting to finally go back to Nvidia cards, I can't say trying ATI again was the best of choices, it really wasn't to me.

Dont want to start an "how many fps can my eye see" crap thread...
But you should google a bit how our eye works, why movies were/are usually recorded in ~25/30 fps, and how a game(+input) differs from a movie.
PS: Also games dont have constant framerates like movies.
