I don't think that's how Nintendo will see it.
I would like to see the email printed here.
You will not get permission I assure you, if you go ahead without permission prepare for legal action like Bid For Power saw from FUNimation for illegal use of it's licensed characters.
If no one get's this reference, I will know that I truly have no life.
They are well within their rights to shut a mod like this down through the use of legal action
if anyone simply let others use their stuff it will no longer be 'theirs'
this almost hapened to companies like xerox and kleenex (all photocopys were called xeroxes and thus it was starting to loose trademarke status)
basicaly, if something becomes over used you cant copyriight/trademark (I am using both b/c I don't remember wich is wich)
sorta like some one trying to copyright the yellow smilly (It actualy originaly was ;D)

Best of luck, but my guess is that this will go the way of the DragonballZ mods. If you're lucky, Nintendo will pull a Capcom (who are allowing the production of <i>Resident Evil: The Escape</i> for HL). But I wouldn't bet on it. Nintendo guards its characters - especially its flagship titles like Mario and Zelda - pretty jealously.
