As far as I can tell, the bones are preserved when exporting to .3ds. Because I exported to 3ds saved it, then exported back to milkshape, and the bones were still there. I think the problem is, I just don't know how to get the bones to show up, or maybe 3ds just uses a new system now. I don't know...

i've got max 4.2, and i'm just hitting Maxscripts pulldown menu from up top (wehre file, edit, tools is....) then selection run script... and selecting SMDImporter.ms

i could not find the web page but here is the scrip file
instal it to
C:\3dsmax4\scripts\startup
to run it goto utilities MaxScript then selct the script in the tab thing
you can then import smd referance and animation files
