I was simply clarifying that he could not be sued as Liku suggested. By no means do I condone this in any way, nor have I ever met anyone who uses the "they arn't asking for $$" argument to brush off plagiarism/theft.

Well, you're mostly right. I'm not an expert, but according to everything I've been taught about slander and libel law, he could sue if he could prove that the accuser knew the statements were false and said/wrote them anyway. If the accuser didn't know (or if the accusations were in fact true), then there's no grounds for a suit. The malicious intent bit only comes into play if the plaintiff is a government official or some other public figure, as they pretty much get slandered and libeled all the time by traditional definitions.
Easiest way to defend yourself if you get sued is to prove the accusations true, and then it's really awfully hard for the prosecution to get a judgement in their favor <!--emo&;)--><img src='http://www.unknownworlds.com/forums/html//emoticons/wink.gif' border='0' style='vertical-align:middle' alt='wink.gif' /><!--endemo-->
