OK, now of course I don't believe that Green Day ripped this melody off on purpose but, the similarities are striking and the original song is quite obscure, only a true Motley Crue fan would have noticed it - so if they were to rip a song off, this would be a safe choice - sorta.
I have included a sound clip I made myself, first it plays Green Day, then Motley Crue, then back to Green Day, tell me if you hear what I do. I find this shockingly too close for comfort.

Well it isn't the beat, it's the melody, listen to the green day singer and then the motley singer. It sounds soooo similar.

I wouldn't doubt it.
Or perhaps they're fans and he subconsciously "stole" the melody. Or maybe it's just a freakish coincidence, I know one time I was jamming out to a riff I "made" on my guitar, only to realize it was a LostProphets riff...
I don't really care about any of this, I just thought it was odd, I was mapping and listening to my new CD. (What I do with all new CDs I get.. pop 'em in and rock out whilst mapping <!--emo&:)--><img src='http://www.unknownworlds.com/forums/html/emoticons/smile-fix.gif' border='0' style='vertical-align:middle' alt='smile-fix.gif' /><!--endemo--> - I always listen to new CDs straight through) and was like, wait a second, that melody is sooo familiar.... heh

I don't know... the vocals seem really similar, regardless of what progression they're using, (the same or not) the vocals have freedom to go up and down within the key of the song and the fact that they both take a pause at the same point, drop off at the same point etc. makes this either a COLOSSAL coincidence or a rip-off.
We'll probably never know...

rhythm. Sure, pretty similar rhythm and I'm not discounting it, but I don't really know this style of music too well so I don't have the library to compare it to. For all I know it's pretty common. But there are only a few poetic rhythms that are often used in pop music, mainly because it has to fit in the very regular metre of the music.
That's not a very good song anyways. They have much better stuff.
Nowhere near as blatant as Ice Ice Baby/Under Pressure, or the Doom music rips.
How 'bout Hammer stealing the riff from Rick James' 'Superfreak?'
It's from the album "Too Fast for Love" come to think of it, maybe it was 1980, but I thought '81. Not sure. Oh well.
